WEBSITE TERMS AND CONDITIONS

These Terms and Conditions govern your use of cmrental.ca and manuals.cmrental.ca (the “Site”) and any booking you make through the Site. Please read them carefully. By using the Site or making a booking, you agree to these Terms.

1. THESE TERMS AND THE RENTAL AGREEMENT
1.1 These Terms govern your use of the Site and the booking process.
1.2 Every rental of equipment from us is separately governed by our Master Equipment Rental Agreement, which is available on the Site and which you must accept at checkout and sign electronically before we release any equipment to you. The Master Equipment Rental Agreement contains important provisions about safety, assumption of risk, your responsibility for loss and damage, limitation of our liability, and indemnity.
1.3 If there is any inconsistency between these Terms and the Master Equipment Rental Agreement in relation to a rental, the Master Equipment Rental Agreement governs.
1.4 Purchases of consumable items through the Site are governed by section 8 of these Terms and by section 20 of the Master Equipment Rental Agreement.
2. ELIGIBILITY
2.1 You must be at least 19 years of age to book or rent equipment.
2.2 If you are booking on behalf of a company, partnership or other organization, you confirm that you are authorized to bind that organization.
2.3 We may require government issued photo identification before releasing equipment, and we may decline any booking at our discretion.
3. EQUIPMENT
3.1 All of our rental equipment is previously used equipment. It is professionally maintained, inspected and serviced between rentals, and it is rented as used goods on an “as is, where is” basis.
3.2 Product photographs and descriptions on the Site are indicative. The specific item you receive may differ in age, appearance and condition from the item shown.
3.3 We may substitute comparable equipment where the item you booked is unavailable, unsafe or not returned by a previous renter. If we cannot supply comparable equipment, we will cancel the booking and refund you in full.
4. BOOKINGS
4.1 A booking is completed when you select equipment and rental dates, accept the Master Equipment Rental Agreement and these Terms, and pay at checkout.
4.2 Your booking is conditional. We will send you the Master Equipment Rental Agreement for electronic signature after checkout. We will not release equipment to you until you have signed it and completed identity verification.
4.3 If you do not sign the Master Equipment Rental Agreement before your scheduled pickup time, we may cancel your booking and refund your rental charges in full.
4.4 You will receive a booking confirmation by email. That confirmation is your Rental Schedule and it forms part of the Master Equipment Rental Agreement.
5. PRICES, TAXES AND PAYMENT
5.1 All prices are shown in Canadian dollars and are exclusive of applicable taxes unless stated otherwise. Applicable taxes are shown at checkout.
5.2 Your rental charges are paid in two stages. Fifty percent is charged at checkout when you book (the booking deposit). The remaining fifty percent is charged when you collect or we deliver the equipment. Both amounts are shown at checkout and in your booking confirmation.
5.2A If the second charge is declined and you do not give us another payment method, we may hold the equipment and cancel the booking under section 6.
5.3 A damage deposit is required for every rental. The amount is shown at checkout and in your booking confirmation. It is taken by pre authorization or charge on your credit card at or before the time equipment is released, and it is held until we have inspected the returned equipment.
5.4 We apply the damage deposit against any amounts you owe, including damage, cleaning, missing components, refuelling or recharging, and late return charges. We release the balance within three business days after inspection. Where the deposit was taken as a pre authorization hold, the time your bank takes to remove the hold from your account is outside our control.
5.5 If the amounts you owe exceed the damage deposit, we will invoice you for the difference and you must pay within fifteen days.
5.6 Payments are processed by Stripe. We do not store your full card details.
6. CANCELLATIONS, CHANGES AND REFUNDS
6.1 You may cancel a booking by emailing [email protected]. Refunds are calculated by reference to when we receive your cancellation:

6.1A We will never charge you more than the booking deposit if you cancel. The remaining fifty percent is simply not taken.
6.2 You may request a change to your rental dates. We will accommodate a change requested 48 hours or more before pickup where the equipment is available, at no charge. Later change requests are treated as a cancellation and a new booking.
6.3 If we cancel your booking, you receive a full refund of rental charges.
6.4 Refunds are made to the original payment method.
6.5 Nothing in this section limits any cancellation right you have under the Business Practices and Consumer Protection Act that cannot lawfully be waived.
7. PICKUP, RETURN AND DELIVERY
7.1 Equipment is collected from and returned to our location at Cowichan Bay unless we have agreed to deliver.
7.2 Where we make equipment available for unattended pickup or return using our secured cabinet and electronic lock box, the procedure in Schedule B to the Master Equipment Rental Agreement applies. Your rental is not returned until you have followed that procedure in full.
7.3 Where we agree to deliver or collect equipment, delivery charges are shown at checkout and the delivery terms in section 16 of the Master Equipment Rental Agreement apply.
7.4 Late returns are charged at the daily rate shown in your booking confirmation, in addition to any other amounts you owe.
8. CONSUMABLES AND ACCESSORIES
8.1 Blades, bits, discs, fasteners, abrasives, safety accessories and similar items offered on the Site are sold, not rented.
8.2 You are responsible for selecting items that are compatible with the equipment you are renting and appropriate for your task, and for installing them correctly in accordance with the manufacturer’s instructions. We will install a purchased blade or accessory for you before release at no charge if you ask us to, and we encourage you to do so.
8.3 We sell personal protective equipment as a convenience. We do not represent that any item of personal protective equipment is suitable, rated or adequate for any particular task, hazard or piece of equipment. Any rating or standard shown on a product listing is reproduced from the manufacturer’s own published material. Selecting appropriate personal protective equipment is your responsibility.
8.4 Consumables are not returnable once used or installed. Unused and unopened items may be returned within 14 days with proof of purchase.
8.5 Nothing in these Terms excludes any condition or warranty implied by the Sale of Goods Act or any other statute where that exclusion would be void, including on a retail sale of new goods to a consumer.
9. MANUAL LIBRARY
9.1 We publish manufacturer operating instructions and manuals at manuals.cmrental.ca as a convenience.
9.2 We did not prepare those materials. We do not warrant that they are complete, current or applicable to your intended use. You must read the operating instructions for any equipment before you use it and ensure that anyone else who operates it does the same.
10. YOUR USE OF THE SITE
10.1 You may use the Site only for lawful purposes and in accordance with these Terms.
10.2 You must not attempt to gain unauthorized access to the Site, interfere with its operation, introduce malicious code, scrape or harvest data, or use the Site in any way that could damage or impair it.
10.3 If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account.
11. INTELLECTUAL PROPERTY
11.1 The Site, its content, layout, text, graphics and the CM Rentals name and logo are owned by or licensed to us and are protected by copyright and trademark law.
11.2 You may not reproduce, distribute, modify or create derivative works from the Site without our written permission, other than for your own personal, non commercial use.
11.3 Manufacturer manuals published on the Site remain the property of their respective owners.
12. AVAILABILITY OF THE SITE
We do not guarantee that the Site will be available uninterrupted or error free. We may suspend, withdraw or restrict all or part of the Site without notice.
13. LIMITATION OF LIABILITY
13.1 To the fullest extent permitted by law, we are not liable for any indirect, consequential, special or incidental loss, or for loss of profits, revenue, business, goodwill or opportunity, arising from your use of the Site.
13.2 Our liability in connection with any rental is governed by section 21 of the Master Equipment Rental Agreement.
13.3 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, or any right you have under the Business Practices and Consumer Protection Act or the Sale of Goods Act that cannot lawfully be waived.
14. PRIVACY
Our collection, use and disclosure of personal information is governed by our Privacy Policy, available on the Site.
15. THIRD PARTY LINKS
The Site may link to third party websites. We do not control those sites and are not responsible for their content, products or privacy practices.
16. CHANGES TO THESE TERMS
We may amend these Terms from time to time. The version in force at the time you make a booking applies to that booking. Each version is identified by version number and effective date, and we retain superseded versions.
17. GOVERNING LAW AND DISPUTES
17.1 These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia.
17.2 Subject to section 17.3, the courts of British Columbia have jurisdiction over any dispute arising from these Terms.
17.3 Nothing in these Terms limits the jurisdiction of the Civil Resolution Tribunal or the Provincial Court of British Columbia (Small Claims), or your right to bring a claim in either forum.
